1. Acceptance of Terms

By accessing or using the website at www.clearwyn.ca (the "Site") or by engaging ClearWyn Facility Services Ltd. ("we," "our," or "us") to provide commercial cleaning services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Site or services.

2. Services

ClearWyn Facility Services Ltd. provides commercial cleaning services in Calgary, Alberta, including but not limited to office cleaning, janitorial services, medical clinic cleaning, warehouse cleaning, and after hours cleaning.

The specific scope, frequency, pricing, and schedule of any cleaning service will be set out in a separate written quote or service agreement provided to you prior to commencement. These Terms of Service apply in addition to and supplement any such service agreement.

3. Quotes and Pricing

All quotes provided by ClearWyn Facility Services Ltd. are free of charge and carry no obligation. Quotes are valid for 30 days from the date of issue unless otherwise stated. We reserve the right to revise a quote if the scope of work changes materially from what was originally described.

All pricing is in Canadian dollars (CAD) and is exclusive of applicable taxes unless otherwise stated.

4. Satisfaction Guarantee and Refund Policy

100% Satisfaction Guarantee: If any aspect of a completed cleaning service does not meet the standard agreed in your service quote, we will return to rectify the issue at no additional cost, provided you notify us within 48 hours of the completed service.

72-Hour Money-Back Guarantee (First Clean): New clients who are not satisfied with the quality of their first cleaning service may request a full refund within 72 hours of service completion. Refund requests must be submitted in writing to info@clearwyn.ca. Refunds are processed within 5–10 business days to the original payment method.

These guarantees do not apply where the client has prevented access to the premises, provided incorrect information about the facility, or where the dissatisfaction relates to factors outside the scope of the agreed service.

5. Client Responsibilities

You agree to:

  • Provide accurate information about your facility, including size, access requirements, and any health or safety considerations.
  • Ensure our cleaning team has safe and unobstructed access to your premises at the agreed time.
  • Provide any access codes, keys, or fob arrangements required for after hours cleaning in a timely manner.
  • Notify us promptly of any changes to your premises, access arrangements, or scheduling requirements.
  • Ensure our team is informed of any hazardous materials, sensitive equipment, or restricted areas on your premises.

6. Cancellation and Rescheduling

We request a minimum of 48 hours' notice for cancellation or rescheduling of a booked cleaning service. Cancellations made with less than 48 hours' notice may be subject to a cancellation fee as set out in your service agreement. Emergency cancellations due to circumstances outside your reasonable control will be handled on a case-by-case basis.

7. Insurance and Liability

ClearWyn Facility Services Ltd. carries comprehensive general liability insurance and is fully insured. Proof of insurance is available upon request.

Our liability for any damage caused by our cleaning team while on your premises is limited to the cost of repair or replacement of the damaged item, up to the limits of our insurance coverage. We are not liable for pre-existing damage, normal wear and tear, or damage caused by circumstances outside our control.

We are not liable for any indirect, consequential, or economic losses arising from the provision or non-provision of our services.

8. Intellectual Property

All content on this Site, including text, graphics, logos, images, and code, is the property of ClearWyn Facility Services Ltd. or its content suppliers and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use any content from this Site without our express written permission.

9. Website Use

You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others. You must not use the Site in any way that disrupts or damages its functionality or that attempts to gain unauthorised access to any part of the Site or its underlying systems.

10. Third-Party Links

This Site may contain links to third-party websites. These links are provided for your convenience only. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage that may arise from your use of them.

11. Disclaimer of Warranties

This Site is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted or error-free, that defects will be corrected, or that the Site or the server that makes it available are free of viruses or other harmful components.

12. Governing Law

These Terms of Service are governed by the laws of the Province of Alberta and the laws of Canada applicable therein. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Alberta.

13. Referral Program

The ClearWyn referral program rewards existing clients who introduce new Calgary businesses to our services. The terms below govern how referrals, qualification, and discounts work. By submitting a referral or accepting a referred discount you agree to these terms.

13.1 Eligibility

Only active ClearWyn clients with at least one fully completed and paid recurring clean may submit referrals. The referrer must remain an active paying client at the time the referral discount activates and for the full duration of the discount period. The referred party (referee) must be a Calgary commercial business that is not currently a ClearWyn client and is not the same legal entity, related entity, or shared billing party as the referrer.

13.2 The Discount

When a successful referral qualifies under these terms, both the referrer and the referee receive a 10% discount on their recurring monthly base service fees for 6 consecutive months. The discount applies to recurring base service fees only. Add on services (deep cleans, carpet shampoo, post construction cleans, window service, and any other one off booking) and any fees unrelated to the recurring contract are excluded from the discount.

13.3 Qualification

A referral becomes successful and the discount activates only after all of the following conditions are met:

  • The referee signs a recurring service agreement with ClearWyn.
  • The referee receives their first scheduled clean.
  • The first invoice for the referee is paid in full.
  • The 72 hour money back guarantee window on the referee's first clean has passed without a refund being requested.

The 6 month discount period begins the day after these conditions are satisfied. Discounts do not apply retroactively to invoices issued before activation.

13.4 When the Discount is Voided

The referral discount will be voided for both the referrer and the referee, with no further obligation on ClearWyn, in any of the following situations:

  • The referee submits a 72 hour money back guarantee claim on their first clean. In this case the discount never activates and no credit is issued to either party.
  • The referee cancels their service agreement within the first 90 days of their contract. Any discount already applied will end at the cancellation date and any future scheduled discounts are forfeited.
  • Either party falls into arrears on payments, breaches the service agreement, or has services suspended.
  • ClearWyn reasonably determines that the referral was fraudulent, self generated, or used to circumvent these terms (for example two accounts under the same operator, shared billing, related parties, or coordinated cancellation patterns).

13.5 Limits

  • A client may have only one active referral discount at a time. If a second referral becomes successful while a first discount is still running, the second discount queues and begins when the first one ends.
  • Referral discounts cannot be combined with other promotional offers, bundle pricing, or one off discounts.
  • The discount has no cash value, is non transferable, and cannot be exchanged for cash, credit, or services outside the recurring contract.
  • There is no limit on the number of referrals a client may submit, but only one earned discount applies at a time as described above.

13.6 Verification and Right to Refuse

ClearWyn reserves the right to verify the legitimacy of any referral, request additional information from either party, and refuse, modify, or revoke any discount where these terms are not met or where abuse is reasonably suspected. ClearWyn's determination on referral eligibility and qualification is final.

13.7 Changes to the Program

ClearWyn may modify, suspend, or terminate the referral program at any time. Active discounts already in their 6 month period at the time of program changes will continue to apply at the original 10% rate until their original expiration date, unless voided under section 13.4.

14. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be effective immediately upon posting to this page with an updated "Last updated" date. Your continued use of the Site or our services after any changes constitutes your acceptance of the revised terms.
